Passenger sues vehicle owner, drivers for negligence in vehicle accident

CHARLESTON — A woman is suing the owner and drivers of a vehicle, citing alleged negligence.

Alyssa Musgrave filed a complaint on Nov. 7 in the Kanawha Circuit Court against Richard Burnette, City Preowned Motors LLC and Samantha Cato, alleging Burnette and Cato breached their duty to exercise the highest degree of care in operating their respective vehicles.

According to the complaint, the plaintiff alleges that on Nov. 8, 2017, she was a front seat passenger in her sister Samantha Cato's vehicle when they were involved in an accident that occurred on W.Va. 25 in Nitro. She sustained injuries which resulted in medical expenses, physical and mental pain, loss of ability to enjoy life and lost wages. 

The plaintiff holds Burnette, City Preowned and Cato responsible because Burnette failed to keep careful lookout and failed to stop the van owned and insured by City Preowned and caused it to crash into Cato's vehicle.

The plaintiff requests a trial by jury and seeks all damages, with interest, costs and expenses and and such other and further relief to which she may be justly entitled. She is represented by S. Brooks West II and Nathan J. Chill of West Law Firm LC in South Charleston.
