Passenger sues Kroger and its driver after collision

CHARLESTON — A passenger is suing Kroger and an employee, citing alleged negligence.

Jessica Leann McClung filed a complaint in Kanawha Circuit Court against The Kroger Company, Bryan A. Snuffer, et al alleging Snuffer failed to maintain control of his vehicle.

According to the complaint, the plaintiff alleges that on Nov. 28, 2016, she was a front seat passenger in a Ford Focus when she was injured in a motor vehicle collision at or near the intersection of U.S. 60 and Hewitt Drive in St. Albans. She sustained bodily injuries resulting in medical expenses, pain and suffering, annoyance and inconvenience. The plaintiff holds Kroger, Snuffer and others responsible because Snuffer negligently and recklessly caused the van owned by defendant Kroger to struck the rear of the vehicle in which she was a passenger.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, with interest, attorney's fees, costs and expenses and such other and further relief deemed just and appropriate. She is represented by Robert D. Cline Jr., Robert A. Campbell and Jennifer D. Roush of Farmer Cline & Campbell PLLC in Charleston.
