Contractor claims property owners didn't pay for services

WHEELING — A contractor is suing property owners, citing alleged breach of contract and unjust enrichment.

Walters Construction Inc. filed a complaint in Ohio Circuit Court against MPT of Wheeling-Alecto LLC and Alecto Healthcare Services Wheeling LLC alleging that the property owners failed to perform their obligations under the terms of the contract.

According to the complaint, the plaintiff alleges that it provided labor, materials, equipment and supervision to improve the defendants' property for a total amount of $420,118.10. As of of the filing of this complaint, defendants are delinquent in the amount of $463,001.70, including late charges. Plaintiff filed a mechanic's lien upon the properties owned by defendants. The plaintiff holds MPT of Wheeling-Alecto LLC and Alecto Healthcare Services Wheeling LLC responsible because the defendant allegedly failed and refused to pay the full amount owed.

The plaintiff requests a trial by jury and seeks judgment against defendants in the amount of $463,001.70 plus late fees and interest, and an order foreclosing defendants' interest in the property in plaintiff's favor to satisfy the liens, and such other proper and necessary relief. It is represented by Erik A. Schramm of Hanlon, Estadt, McCormick & Schramm Co., LPA in St. Clairsville, Ohio.
