Property owners say sewage system was faulty, sue service district

CHARLESTON — Property owners are suing a government entity, citing alleged violation of statutory duty.

James D. Recco and Mary Recco filed a complaint in Kanawha Circuit Court against Kanawha Public Service District alleging that it failed to properly design, install and maintain its sewage system.

According to the complaint, the plaintiffs allege that on numerous occasions they suffered substantial property damage due to raw sewage and wastewater backing up to the basement of their residence. The plaintiffs hold Kanawha Public Service District responsible because despite continuously requesting the defendant fix the problems, defendant failed and refused to do so and failed to compensate the Reccos for their damages.

The plaintiffs request a trial by jury and seek damages in an amount to be determined by jury, costs, attorney's fees and such other and further relief deemed just. They are represented by Michael J. Del Giudice of Ciccarello, Del Giudice & LaFon in Charleston.
