United Talent says corporation didn't pay for services, sues

CHARLESTON — An employment agency is suing an Ohio corporation, citing alleged breach of agreement.

United Talent LLC filed a complaint in Kanawha Circuit Court against RD Swindell Enterprises Inc. alleging that the Ohio corporation failed to perform its duty under the contract.

According to the complaint, on March 25, 2018, the plaintiff agreed to provide temporary employees to the defendant in exchange for certain payments. After allowing proper credits for all payments, $10,488.45 remains due and owing. The plaintiff holds RD Swindell Enterprises Inc. responsible because the defendant allegedly refused to pay for the plaintiff's services.

The plaintiff requests a trial by jury and seeks judgment against defendant in the amount of $10,488.45, plus interest, costs, attorney's fees, and such other and further relief deemed proper and just. It is represented by Christopher J. Winton of Ray, Winton & Kelley PLLC in Charleston.
