Kanawha Co. couple claims surgeon and medical center were negligent

CHARLESTON — A woman and and her husband are suing a doctor and a medical center, citing alleged negligence.

Barbara Riley and David Riley filed a complaint in Kanawha Circuit Court against Ronald McCowan, M.D. and Charleston Area Medical Center, alleging that they negligently deviated from the standards of medical care.

According to the complaint, the plaintiffs allege that on Dec. 7, 2009, Barbara Riley underwent surgery for placement of an ICD performed by Dr. McCowan. As a result of his negligent acts and omissions, she underwent a second surgery on Feb. 2, 2017, to remove a retained surgical sponge. She suffered significant pain and suffering, delay in recuperation and inability to resume normal daily  activities. The plaintiffs holds Ronald McCowan, M.D. and Charleston Area Medical Center responsible because of the failure to remove the raytec-type sponge before the close of surgery.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount that will adequately compensate them for their damages, and such other and further relief as may be proper. They are represented by Tony L. O'Dell and Cheryl A. Fisher of Tiano O'Dell PLLC in Charleston.
