Ohio resident suing Wheeling police officer, alleging negligence

WHEELING — An Ohio resident is suing a city government and a polic officer, citing alleged negligence.

Eric Michael Stewart filed a complaint in Ohio Circuit Court against the City of Wheeling and John Doe, a police officer, alleging that they failed to adequately protect and serve the public and/or respond to an emergency situation.

According to the complaint, Stewart alleges that on Nov. 5, 2016, while he was traveling along Warwood Avenue in Wheeling, he struck a parked 2001 Jeep Cherokee Sport SUV and ultimately hit a tree on the right side of the roadway, causing his 1986 Ford F-250 pickup truck to sustain severe deformation that required the vehicle to be towed, and causing injuries to his body and great pain and suffering. 

The plaintiff holds the City of Wheeling and John Doe responsible because they allegedly failed to fairly investigate the accident and to ensure that all persons involved in the accident did not require medical assistance and/or transportation.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages, plus interest, costs, attorney's fees, and further relief as the court deems just. He is represented by Ronald W. Zavolta, Jordan M. Laird and Paul J. Ratcliffe of Zavolta Law Office in Wheeling.
