Next of kin sues memorialization service provider, citing grave desecration

LOGAN — A man has filed a class-action lawsuit against a memorialization service provider, citing alleged common law grave desecration.

James Doczi, individually and on behalf of all others similarly situated, filed a complaint in Logan Circuit Court against StoneMor Partners LP d/b/a Highland Memory Gardens alleging that it violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that he experienced a damaged and sinking headstone from mowing, digging and excavation, theft and debris on the gravesite, in direct contradiction to the defendant's representations. The plaintiff holds StoneMor Partners LP d/b/a Highland Memory Gardens responsible because it allegedly failed to ensure that the headstones wouldn't be damaged and sink, and wouldn't cause harm to his next-of-kin's gravesite.

The plaintiff requests a trial by jury and seeks an order certifying this action as a class action and appointing plaintiff and his counsel as representatives and award for all damages, costs, attorney's fees and such other just and equitable relief. He is represented by D. Adrian Hoosier II of Hoosier Law Firm PLLC in Charleston.
