Consumer sues debt collector, citing unlawful publication of debt

CHARLESTON — A consumer is suing a debt collector, citing alleged negligence and unlawful publication of debt.

Stephen Sites filed a complaint in Kanawha Circuit Court against Portfolio Recovery Associates LLC alleging that it violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, Sites alleges that he suffered undue and unreasonable harassment, oppression, abuse, annoyance and inconvenience. He holds Portfolio Recovery Associates LLC responsible because it allegedly contacted individuals who were not involved and were not listed as a debtor on his alleged debt.

The plaintiff requests a trial by jury and seeks to recover in excess of the sum of $74,999, plus interest and costs. He is represented by Michael M. Cary of Cary Law Office PLLC in Charleston.
