Couple sues after wife falls in parking lot

NEW CUMBERLAND — A couple is suing a retail food company, citing alleged negligence.

Rebecca and John Szczerbinski filed a complaint in Hancock Circuit Court against DRG Inc. alleging that the defendant breached its duty to an remove unsafe and hazardous condition in the parking lot of its business premises. DRG does business as Granato's Imported Foods & Deli.

According to the complaint, on Nov. 22, 2016, Rebecca Szczerbinski visited defendant's place of business and fell to the ground as she attempted to enter the parking area, which the complaint alleges had an unsafe design and construction. 

As a result, she sustained various injuries that denied John Szczerbinski the services and companionship of his wife. 

The plaintiffs holds DRG responsible because it allegedly failed to provide a business invitee with a safe environment and failed to inspect, repair and/or maintain the premises.

The plaintiffs request a trial by jury and seek judgment for compensatory and general damages, pre- and post-judgment interest, costs, attorney fees and such other further relief which the court may deem proper. They are represented by Michael A. Adams of Hinerman & Associates, PLLC in Weirton.
