Property owner sues contractor, claims work done poorly

CHARLESTON — A property owner is suing contractors, citing alleged unfair and deceptive practices.

Galan Janeksela filed a complaint in Kanawha Circuit Court against Shawn Andrew Davis and Trinity Design & Construction, LLC, alleging they violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, Janeksela alleges that on Aug. 9, 2017, he contracted the defendants to replace the driveway at his residence at 235 Ariel Heights in Charleston. As a result of their poor performance, Janeksela suffered out-of-pocket expenses, annoyance and inconvenience, and was forced to hire a new contractor to have the driveway redone and replaced. The plaintiff holds Shawn Andrew Davis and Trinity Design & Construction, LLC responsible because they allegedly failed to complete the project in a timely manner, failed to perform work in accordance with the plan and failed to correct the nonconforming work.

The plaintiff requests a trial by jury and seeks actual damages, attorney's fees, costs and such other just and equitable relief. He is represented by J. Andrew Skeens and Eric R. Arnold of Hendrickson & Long PLLC in Charleston.
