Motorist sues vehicle owner and driver, cites negligence

CHARLESTON — A motorist is suing a vehicle owner and a driver, citing alleged negligence.

Brian F. Parrott filed a complaint in Kanawha Circuit Court against Valley Diagnostic Laboratories Inc. and Tracy Daniel Lilly, alleging they breached their duty of care in maintaining and operating a motor vehicle.

According to the complaint, Parrott alleges that on Nov. 30, 2016, he was traveling on Big Chimney Boulevard crossing Elk River Bridge when Lilly's vehicle struck the rear of his vehicle. He suffered injuries resulting in medical bills and expenses, pain and suffering, mental anguish and emotional distress. Parrott holds Valley Diagnostic Laboratories Inc. and Tracy Daniel Lilly responsible because Lilly failed to keep a proper lookout and failed to maintain control of her vehicle.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees, costs, interest and such other lawful relief. He is represented by Michael A. Olivio of Olivio Law Firm PLLC in Charleston.
