Woman blames City of Milton after falling into manhole

HUNTINGTON — A woman is suing her landlords, citing alleged negligence.

April Palmer filed a complaint in Cabell Circuit Court against the City of Milton, et al. alleging they failed to exercise reasonable care to ensure that a manhole was properly covered.

According to the complaint, Palmer alleges that on Nov. 30, 2016, she was walking at her rental property at 205 East Main Street in Milton when she tripped and fell into and through a water or sewage manhole. She sustained injuries and was caused to suffer great pain and mental anguish, and incurred medical bills and expenses. She holds City of Milton, et al responsible because they allegedly failed to give sufficient notice and reasonable warning of the hazardous condition.

The plaintiff requests a trial by jury and seeks damages in excess of the jurisdictional limits of the court, with interest and costs. She is represented by Matthew R. Oliver of Vital & Vital LC in Huntington.
