Consumer sues debt collector, cites telephone harassment

BECKLEY — A consumer is suing a debt collector, citing alleged violation of telephone harassment statutes.

Gregory Kade filed a complaint in Raleigh Circuit Court against Creditor's Collection Service Inc. alleging that it violated the West Virginia Consumer Credit Protection Act.

According to the complaint, Kade alleges that from 2015 to Jan. 1, 2018, he received at least 200 calls from the defendant without his prior express consent. As a result, he has been annoyed, aggravated, harangued and damaged. He holds Creditor's Collection Service Inc. responsible because it allegedly repeatedly made calls using an automated telephone dialing system and/or an artificial or prerecorded voice message.

The plaintiff requests a trial by jury and seeks all damages as well as attorney's fees, costs and such other appropriate relief. He is represented by Paul W. Roop II of Roop Law Office LC in Beckley.
