Electrician sues CSX, alleges unsafe work environment

HUNTINGTON — An electrician is suing a common carrier operator, citing an allegedly unsafe work environment.

James A. Burke filed a complaint in Cabell Circuit Court against CSX Transportation Inc. alleging that it failed to comply with the provisions of the Federal Employers' Liability Act.

According to the complaint, Burke alleges that on Dec. 4, 2015, he was in the course and scope of his employment with the defendant when he suffered severe pain, bruising and injury to his groin and testicles, causing the development of erectile dysfunction. He holds CSX Transportation Inc. responsible because it allegedly failed to provide a reasonably safe place to work.

The plaintiff requests a trial by jury and seeks damages in an amount exceeding the jurisdictional limits of the court, with interest, costs and all other relief that is appropriate. He is represented by Willard J. Moody Jr. and Michael R. Davis of The Moody Law Firm Inc. in Portsmouth.
