CHARLESTON — A consumer is suing a debt collector, citing alleged unlawful collection practices.
Rhonda Dunn filed a complaint in Kanawha Circuit Court against LVNV Funding LLC alleging that it violated the West Virginia Consumer Credit and Protection Act.
According to the complaint, Dunn alleges that as a natural consequence of the defendant's actions, she suffered harassment, embarrassment, oppression, abuse, aggravation, annoyance and inconvenience. She holds LVNV Funding LLC responsible because it allegedly unlawfully called and sent letters to her family members not involved in an alleged debt and effectively published the alleged debt to harass her and coerce payments.
The plaintiff requests a trial by jury and seeks damages of less than $74,999, with interest and costs. She is represented by Michael Cary of The Cary Law Office PLLC in Charleston.
