Auto repair shop claims it did not get paid

ELIZABETH — An auto repair shop is suing a contracting company, citing alleged refusal to apply payments.

Pifer's Service Center, LLC filed a complaint in Wirt Circuit Court against Davis Contracting and Excavating, LLC alleging that it breached its duty to pay for the services requested and received.

According to the complaint, on June 3, 2018, Pifer's Service Center, LLC received a call from the defendant's employee requesting it dispatch a 50-ton conventional wrecker to winch out a truck, trailer and bulldozer. 

After a difficult task performed by the plaintiff, the defendant's truck, trailer and bulldozer were recovered safely, and soon after, Pifer's Service Center discussed the payment for its services. The plaintiff claims that despite its preparing discounted invoices, and the defendant acknowledging the receipt, the defendant allegedly made no payment. The amount billed was $10,542.92. 

The plaintiff holds Davis Contracting and Excavating, LLC responsible because it allegedly failed and refused to pay the original total invoice amount of $10,452.92 after receiving requested services.

The plaintiff requests a trial by jury and seeks judgment for damages, including attorney's fees and expenses. They are represented by Andrew C. Shaffer of Shaffer Law in Charleston.
