Customer sues convenience store, claiming negligence in clearing ice

BECKLEY — A customer is suing a convenience store, citing alleged negligence.

Matthew Wayne Fox filed a complaint Dec. 3 in Raleigh Circuit Court against MGJ, Inc. d/b/a Grandview Shell & Convenience Store, alleging that it breached its duty to use reasonable care to keep its premises safe.

According to the complaint, on Dec. 17, 2016, Fox was a customer at the defendant's store when he allegedly fell on a patch of slippery ice while walking through the exterior premises of the store. 

As a result, Fox claims, he sustained physical injuries, pain and suffering, and medical expenses. 

The plaintiff holds MGJ, Inc. d/b/a Grandview Shell & Convenience Store responsible because it allegedly failed to properly inspect and remove accumulations of ice from the exterior premises of its store.

The plaintiff requests a trial by jury and seeks judgment for compensatory and general damages, pre- and post-judgment interest, cost, attorney fees and such further relief that plaintiff may be entitled. He is represented by Robert P. Lorea of Lorea Law Office PLLC in Charleston.
