Consumer sues automobile manufacturer, alleges breach of warranty

HUNTINGTON — A consumer is suing an automobile manufacturer, citing alleged breach of warranties.

Samuel Frazier filed a complaint in Cabell Circuit Court against FCA US LLC alleging that it violated the West Virginia Code.

According to the complaint, the plaintiff alleges that on June 20, 2017, he purchased a 2017 Jeep Cherokee from the defendant's dealership. After purchase, he experienced nonconformities with the Jeep that substantially impaired its use, market value and safety. Frazier suffered inconvenience and annoyance.

The plaintiff holds FCA US LLC responsible because despite numerous attempts to service the vehicle, it failed to conform the same to its warranties.

The plaintiff requests a trial by jury and seeks revocation of acceptance and award for costs of repairs, attorney's fees, costs and such other proper and fair relief. He is represented by John A. Proctor of Frazier, Oxley & Proctor LC in Huntington.
