Estate co-executors claim negligence resulted in woman's death

HUNTINGTON — Estate co-executors are suing assisted living facility operators, citing alleged negligence.

Diana Allen and Shane Lewis, as co-executors of the estate of Imogene Eva Bailey Bennington, filed a complaint in U.S. District Court for the Southern District of West Virginia Huntington Division against SSA Teays Valley ALF, et al., alleging that they breached the appropriate standards of care in supervising wheelchair-bound patients.

According to the complaint, the plaintiffs allege that on May 11, 2018, Bennington was under the care of the defendants and on a lunch outing when she fell forward on her face and was caused to suffer a comminuted fracture of the ring of CI, a subdural hematoma, a possible dissection of her basal artery and other injuries, all contributing to her death on May 15, 2018. The plaintiffs hold SSA Teays Valley ALF, et al. responsible because they allegedly failed to provide proper assistance on Bennington's transportation for their lunch outing.

The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally, for all damages allowed by law. They are represented by Arden J. Curry of Pauley Curry PLLC in Charleston.
