BECKLEY — A patient is suing health care providers, citing alleged negligence.

Derse Lee Partain filed a complaint in Raleigh Circuit Court against Raleigh General Hospital, West Virginia Vascular Institute and Kumar Rai, M.D. alleging that they failed to exercise ordinary care, skill and ability in treating him.

According to the complaint, Partain alleges that on Oct. 19, 2017, he underwent a left temporal artery biopsy performed by Rai. As a result of negligent acts and omissions he received severe facial burns during the procedure. He was caused to suffer permanent scarring, disfigurement, vision/eyelid dropping and severe dry eyes. 

The plaintiff holds Raleigh General Hospital, West Virginia Vascular Institute and Kumar Rai, M.D. responsible because they allegedly failed to properly assess and prep him for the procedure and failed to follow protocols as required in the procedure.

The plaintiff requests a trial by jury and seeks all damages allowed under the factual circumstances of this case and West Virginia law. He is represented by Tammy Bowles Raines of Tammy Bowles Raines Law Office PLLC in Charleston.
