Real estate owners sue neighbors, alleging infringement

BECKLEY — Real estate owners are suing their neighbors, citing alleged continued infringement upon their property.

W. Williams Excavation LLC and Shelby W. Williams filed a complaint in Raleigh Circuit Court against M & W Contractors Inc. and Carson Henry Meade II, alleging that they negligently converted the plaintiffs' property into a detention basin.

According to the complaint, the plaintiffs allege that in August 2015,, they discovered that the groundwater was no longer draining from their property, causing standing water to build up and rendering their land useless. 

The plaintiffs hold M & W Contractors Inc. and Carson Henry Meade II responsible because they allegedly negligently allowed the culvert pipe on their property to collapsed, placed the culvert in a position to cause water to remain on the plaintiffs' property and refused to remove the obstructions.

The plaintiffs request a trial by jury and seek an order requiring the defendants to remove and replace the culvert to its original position and to remove all obstructions, and award for all damages and all other relief that is proper and just. They are represented by Russell O. Wooton of Wooton & Wooton in Beckley.
