Accounting clerk sues employer, claims violation of labor laws

CLARKSBURG — An accounting clerk is suing an automobile dealer, citing alleged violation of workers' compensation laws.

Lisa Chaplin filed a complaint in U.S. District Court for the Northern District of West Virginia Clarksburg Division against Premier Chevrolet Buick GMC of Morgantown alleging that it violated the Fair Labor Standards Act (FLSA) and the West Virginia Maximum Hours and Overtime Compensation statute.

According to the complaint, Chaplin alleges that she regularly worked more than 40 hours in a week without receiving overtime pay equal to one and one-half times her regular rate of pay. 

The plaintiff holds Premier Chevrolet Buick GMC of Morgantown responsible because it allegedly misclassified her as exempt from FLSA's overtime pay rules and switched her from being paid hourly to being paid salary.

The plaintiff requests a trial by jury and seeks unpaid wages, with interest and all other relief that is necessary and appropriate. She is represented by P. Zachary Stewart of Law Office of P. Zachary Stewart in Weirton.
