Substitute bus driving sues school board, alleging denial of full-time employment

GRAFTON — A substitute school bus driver is suing a school board an employer, citing alleged denial of full-time employment.

Dean Cox filed a complaint in Taylor County District Court against the Taylor County Board of Education alleging failure to hire him as a full-time school bus operator.

According to the complaint, Cox alleges that as a result of the defendant's actions, he has been damaged for not being called out for bus runs based on his seniority. He holds the Taylor County Board of Education responsible because it allegedly did not inform him that there is was a union for school bus operators, did not hire him as a full-time school bus operator and failed to advise him that there is a grievance procedure for resolving employees' employment issues.

The plaintiff requests a trial by jury and seeks declaratory judgment be issued as to whether his superior seniority will entitle him to be a regular, full-time bus operator, and if not, whether his superiority will cause him to be called out as a substitute school bus operator, and if either these determination favor him, then he demands back wages and benefits and all issues so triable.
