Wrongful term 02

PRINCETON — A former employee is suing health care providers, citing alleged age discrimination and wrongful termination.

Bonita Denise Hubbard filed a complaint in Mercer Circuit Court against Rehabilitation Hospital Corporation of America, et al. alleging that they violated the West Virginia Human Rights Act.

According to the complaint, Hubbard alleges that on Oct. 16, 2018, she was terminated from her employment. She has suffered and continues to suffer lost wages and employment benefits, indignity, humiliation and emotional distress.

The plaintiff holds Rehabilitation Hospital Corporation of America, et al. responsible because they allegedly terminated her employment and replaced her with a younger, less qualified and less experienced individual.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, with interest, costs and such other just and equitable relief. She is represented by Mark A. Atkinson of Atkinson & Polak PLLC in Charleston and Michael W. Carey and David R. Pogue of Carey, Scott, Douglas & Kessler PLLC in Charleston.

Mercer Circuit Court Case number 18-C-335
