Allied Realty worker sues after he was hit by heavy machinery

HUNTINGTON — A worker is suing facility operators, citing alleged negligence.

Dale Johnson filed a complaint in Cabell Circuit Court against Allied Realty Corporation and John Doe, alleging that Allied is vicariously liable in damages for the negligence of Doe.

According to the complaint, Johnson alleges that on Dec. 20, 2016, he was working at Allied's facility in Huntington when he was struck by the heavy machinery being operated by Doe. He suffered serious bodily injuries resulting in pain and suffering, medical expenses, lost wages and loss of ability to enjoy life.

The plaintiff holds Allied Realty Corporation and John Doe responsible because Doe allegedly failed to maintain control of the machinery he was operating.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, in an amount in excess of the jurisdictional limits of the court, with interest, costs and such other appropriate relief.
