Doddridge County couple sues pickup truck owner and driver, claiming negligence

WEST UNION — A Doddridge County couple is suing a pickup truck owner and a driver, citing alleged negligence.

Ronald and Julie Clevenger filed a complaint in Doddridge Circuit Court against Kelly Surveying, PLLC and Seth A. Thomas alleging that Kelly Surveying is vicariously liable for the carelessness of Thomas.

According to the complaint, the Clevengers allege that on Jan. 10, 2017, Ronald Clevenger was involved in a T-bone-style collision with the defendants' pickup truck on US Route 30 at or near its intersection with Tarkiln Road in Doddridge County. He sustained severe injuries and incurred medical expenses and other damages. Julie Clevenger loss the consortium, services and comfort of her husband. 

The plaintiffs hold Kelly Surveying, PLLC and Seth A. Thomas responsible because Thomas allegedly failed to keep a proper lookout, failed to yield the right of way and negligently pulled out onto US Route 50 and directly into the path of their vehicle.

The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally, in an amount that will fully compensate them for their damages, with interest, and all other relief afforded by law. They are represented by J. Michael Benninger of Benninger Law in Morgantown.
