Injured motorist suing two drivers after collision

CHARLESTON — A motorist is suing two drivers, citing alleged negligence.

Matthew Quintin-Joseph Benincosa filed a complaint in Kanawha Circuit Court against Renae Marie Bonnett and Mark Vance Halburn, alleging that they failed to maintain their vehicles under proper control.

According to the complaint, Benincosa alleges that on Dec. 5, 2016, he was traveling eastbound on Interstate 64 near Nitro when he was involved in an accident with the defendants' vehicles. He sustained injuries to his head, neck, shoulder, back and knees. 

The plaintiff holds Bonnett and Halburn responsible because Bonnett allegedly failed to keep a proper distance from his vehicle and Halburn allegedly failed to obey traffic signs and marks in a construction zone.

The plaintiff requests a trial by jury and seeks all damages, litigation costs, fees and expenses and such other legal and equitable relief. He is represented by Phillip Estep of Phillip Estep Law Group PLLC in Charleston.
