Injured motorist claims negligence after auto collision

CHARLESTON — A motorist is suing an insurance company, a business and individuals citing alleged breach of contract and negligence.

Ralph L. Staton filed a complaint in Kanawha Circuit Court against Cheri Lamb, Progressive Max Insurance Company, et al., alleging that Progressive failed to pay him money to which he is legally entitled.

According to the complaint, Staton alleges that on Dec. 22, 2016, he was injured in a motor vehicle collision with an underinsured driver at the intersection of Edgewood Drive and Beech Street in the City of Charleston. He sustained injuries resulting in great pain and suffering, medical expenses and loss of ability to enjoy life.

The plaintiff holds Cheri Lamb, Progressive Max Insurance Company, et al. responsible because Lamb allegedly negligently operated her vehicle and caused it to collide with his vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that will adequately compensate him for damages he sustained, attorney's fees, costs, interest and such other necessary relief. He is represented by Patrick K. Maroney of Maroney, Williams, Weaver & Pancake PLLC in Charleston.
