Former inmate sues correction officer alleging unlawful use of excessive force

CHARLESTON — A former inmate is suing a correctional officer, citing alleged assault and battery.

Douglas Kidd III filed a complaint in Kanawha Circuit Court against Troy White alleging that he violated the 8th Amendment of the Constitution.

According to the complaint, Kidd alleges that on Nov. 8, 2017, he was an inmate of the West Virginia Regional Jail and Correctional Facility when he was attacked by White and was severely injured. He suffered permanent lost of vision in one eye and injuries to his back, neck, chest and ribs that required multiple surgeries that were unsuccessful. 

The plaintiff holds Troy White responsible because he allegedly attacked him, slammed him to the ground and elbowed his head.

The plaintiff seeks compensatory and punitive damages, with interest, court costs, attorney's fees and expenses. He is represented by Paul E. Stroebel of Stroebel & Johnson PLLC in Charleston.
