Company sues estate and individuals, wants possession of property

CHARLESTON — An LLC is suing for possession of property whose previous owner bought it at a tax auction.

American Pride Properties LLC filed a complaint in Kanawha Circuit Court against Arnold Moltis, the Estate of Cora L. Hudson, et al. for complaint to quiet title.

According to the complaint, the plaintiff alleges that no party or any of the defendants paid taxes and redeemed the property located at 66 Dunbar Ave. in Kanawha County, to which the plaintiff's predecessor in title purchased a tax lien on the property at an annual sheriff's tax liens sale of properties with delinquent 2015 taxes. 

The plaintiff holds Arnold Moltis, the Estate of Cora L. Hudson, et al. responsible because they allegedly failed to pay taxes and redeem the property before the scheduled date, and failed to acknowledge all notices due.

The plaintiff requests a trial by jury and seeks judgment in its favor, possession of the property and assistance of a sheriff in the eviction of the defendants if necessary, and further general and special relief. They are represented by John Kennedy Bailey of John Kennedy Bailey PLLC in Charleston.
