Landlord suing Firehouse Subs owner for alleged breach of contract

CHARLESTON — A landlord is suing a tenant and guarantors, citing alleged breach of contract.

Ridge Line Inc. filed a complaint in Kanawha Circuit Court against The Farley Group LLC, Daniel Farley and Leonard Farley, alleging that they failed their duty to pay rent.

According to the complaint, Ridge Line alleges that it suffered substantial monetary injur, as a result of the wrongful conduct of the defendants as tenant and guarantors to make the necessary monthly payments, now amounting to $29,436 with accruing interest, for rental of a commercial space for their restaurant, Firehouse Subs, located at 2828 Mountaineer Boulevard in Charleston.

The plaintiff holds The Farley Group LLC, Daniel Farley and Leonard Farley responsible because they allegedly failed to cure the noticed default, failed to make the necessary monthly payments and obligated the plaintiff to retain and pay for legal counsel.

The plaintiff requests a trial by jury and seeks judgment against the defendants in the amount of $29,436, immediate possession of the property, additional monthly payments, costs, fees, expenses, interest and further relief as may be proper. They are represented by W. Bradley Sorrells of Robinson & McElwee PLLC in Charleston.
