Limited liability company sues borrowers for unpaid loan

CHARLESTON — A limited liability company is suing borrowers, citing alleged breach of loan agreement.

ZWT Ranch LLC filed a complaint in Kanawha Circuit Court against Thoroughbred Highwall Mining LLC and Billy Ward, alleging that they failed to perform their contractual obligations.

According to the complaint, the plaintiff alleges that on April 12, 2017, it loaned the defendants, jointly and severally,  $15,000. To date, the loan remains due and unpaid.

The plaintiff holds Thoroughbred Highwall Mining LLC and Billy Ward responsible because despite demand for payments, they allegedly refused to repay the loan.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, in the amount of $15,000, plus interest, costs and expenses and such other just and proper relief. He is represented by Gregory W. Sproles of Gregory W. Sproles PLLC in Summersville.
