Landscaping company seeks payment for work it performed

WINFIELD — A landscaping company is suing a construction company, citing alleged breach of contract and unjust enrichment.

Crede Lawn Service, LLC filed a complaint in Putnam Circuit Court against Wolfe Construction Company Inc. alleging that it breached its contractual obligations by failing to pay in full for materials and services rendered.

According to the complaint, Crede Lawn Service contracted with Wolfe to perform landscaping and paver work for Valley Park. Crede Lawn Service claims it fulfilled its obligations under the contract and timely invoiced the defendant. However, despite providing excellent landscaping services, the defendant allegedly did not tender payment for the total amount of $64,576.58. 

The plaintiff holds Wolfe Construction Company, Inc. responsible because it allegedly failed to pay and refuses to pay for the work performed.

The plaintiff requests a trial by jury and seeks judgment of compensatory damages of $64,576.58, pre- and post-judgment interest, costs and such other and further relief as the Court deems proper. It is represented by Patrick C. Timony of Bowles Rice LLP in Charleston.
