CHARLESTON — A deceased man's former wife is suing a financial service company and an estate administrator, citing alleged unjust enrichment.
Ellen S. Wang filed a complaint in Kanawha Circuit Court against TD Ameritrade, Inc. and Thomas L. Wang, administrator of the estate of Donal Ling Wang, alleging that they refused to acknowledge her rights under accounts owned by Donald Ling Wang.
According to the complaint, on Oct. 13, 2017, Ellen Wang received a telephone call from T.D. Ameritrade, Inc. advising her she was the named beneficiary on at least one account with her deceased former husband, Donald Ling Wang. However, despite her efforts, T.D. Ameritrade refused to provide any further information to her regarding the nature or extent of such accounts, or her status as a beneficiary or joint account holder.
The plaintiff holds TD Ameritrade, Inc. and Thomas L. Wang, administrator of the estate of Donald Ling Wang, responsible because they allegedly refused to acknowledge and provide her rights to the estate of the decedent and continued to retain funds without reimbursement to the plaintiff, which she is rightfully and legally entitled to.
The plaintiff requests a trial by jury and seeks to declare her rights as a joint account holder of T.D. Ameritrade accounts held by the decedent and for such other and further relief the Court deems fair, just and proper. She is represented by D.
