CHARLESTON — A property owner is suing property inspectors, citing alleged breach of duty.
Adam Mace filed a complaint in Kanawha Circuit Court against Inspection Connection and Michael Clark alleging that they breached their duty to perform a home inspection in a reasonable and prudent manner.
According to the complaint, Mace entered into a contract agreement with the defendants wherein they would perform an inspection of his property to disclose all imperfections, defects, damages and structural problems.
Mace claims he paid the defendants as agreed but the inspection of his home was done in a reckless and negligent manner.
The plaintiff holds Inspection Connection and Michael Clark responsible because they allegedly failed to report cracks within the interior of the garage foundation, failed to report a bow in the rear foundation wall and failed to report a significant sag within the left side of the main upper floor structure.
The plaintiff requests a trial by jury and seeks judgment for expenses incurred, annoyance, inconvenience, punitive damages and all other relief available at law. He is represented by Charles M. Love IV of The Love Law Firm, PLLC in Charleston.
