Concrete supplier alleges customer did not pay for materials

WINFIELD — A concrete manufacturer is suing a masonry contractor, citing alleged breach of contract.

The Quikrete Companies, LLC filed a complaint in Putnam Circuit Court against Kline Masonry, Inc. alleging that it breached its duty to pay for ordered products.

According to the complaint, The Quikrete Companies, LLC delivered products the defendant ordered on dates Sept. 14, Oct. 12 and 22 and Dec. 22, 2016, and April 10 and 21, 2017. However, the plaintiff claims it received no payment as the defendant did not tender any of the $13,185.22 due. 

The plaintiff holds Kline Masonry, Inc. responsible because it allegedly failed to pay for the ordered products.

The plaintiff requests a trial by jury and seeks judgment for $13,185.22 plus post-judgment interest at the statutory rate on the principal balance, and costs. It is represented by James B. Atkins, Paul S. Atkins and Bree Whipp Ogle of Atkins & Ogle Law Offices, LC in Buffalo.
