Family sues after resident falls in Putnam County nursing home

WINFIELD — A representative is suing healthcare providers, citing alleged negligence.

Karen A. Clemons, who holds durable power of attorney for Daniel J. Clemons, filed a complaint in Putnam Circuit Court against 590 North Poplar Fork Road Operations LLC d/b/a Teays Valley Center and Genesis Healthcare, LLC alleging that they breached their statutorily mandated duty to provide Daniel J. Clemons his nursing home resident's rights.

According to the complaint, on Dec. 21, 2016, when Daniel Clemons was a resident at the defendants' nursing facility, he suffered a fall resulting in an acute traumatic transverse fracture of the right femoral neck. 

As a result, Karen Clemons claims, he sustained serious injuries, resulting in pain and suffering. 

The plaintiff holds 590 North Poplar Fork Road Operations LLC d/b/a Teays Valley Center and Genesis Healthcare, LLC responsible because they allegedly failed to provide a safe environment and failed to provide adequate supervision to prevent injuries.

The plaintiff requests a trial by jury and seeks judgment for punitive damages as well as any other items and relief that the Court sees fit to award. She is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart | Bell, PLLC in Charleston.
