Motorist sues utility truck owner Eagle Distributing Company, driver for negligence

HUNTINGTON — A motorist is suing Eagle Distributing Company and Joseph F. Hiner, utility truck owner and driver, citing alleged negligence.

Ricky E. Hitchcock filed a complaint against the defendants in Cabell Circuit Court alleging that Eagle Distributing negligently entrusted its utility truck to Hiner, a careless employee. According to the lawsuit, the plaintiff alleges that on Jan. 10, 2017, he was operating a 1994 Buick LeSabre on the I-64 on-ramp at Fifth Street Road in Huntington when his vehicle was violently struck by the defendant's utility truck.

He sustained injuries resulting in pain and suffering, medical treatment and hospital care, and diminished capacity to enjoy life. The plaintiff holds Eagle Distributing Company and Joseph F. Hiner responsible because defendant Hiner allegedly failed to maintain proper control of his vehicle.


The plaintiff requests a trial by jury and seeks compensatory damages with interest, costs, attorney's fees and such other just and appropriate relief. He is represented by Kenneth P. Hicks of Kenneth P. Hicks LC in Huntington.
