Lawsuit alleges Farley Group wrongfully terminated man with epilepsy, brain injury

CHARLESTON — A man is suing his former employer, alleging that he was discriminated against and wrongfully terminated because of a disability.

John Barron filed a complaint against The Farley Group, LLC in Kanawha Circuit Court, alleging that the defendant violated the West Virginia Human Rights Act. According to the lawsuit, Barron was hired by defendant in January 2017 and remained employed until his was involuntarily terminated in or around March 2017 because he was too "slow." The plaintiff claims that after being hired, he notified the defendant of his brain injury and that he was epileptic, conditions that affect his physical health and cognitive abilities.

Barron claims that he performed his employment duties in a satisfactory manner and met the reasonable expectations of his employer but that the defendant allegedly never discussed or offered any reasonable accommodations of disability and fired him within several weeks of hiring him. The plaintiff holds The Farley Group, LLC responsible because the company allegedly failed to engage in reasonable and interactive communications to determine whether and to what extent specific reasonable accommodations could be made.


Barron requests a trial by jury and seeks judgment for compensatory and punitive damages, costs of litigation, pre and post-judgment interest, and legal and equitable relief that the court deems appropriate. He is represented by Phillip Estep of Phillip Estep Law Group PLLC in Charleston.
