HUNTINGTON — A Wayne County man is suing a store and its manager, citing alleged negligence.
Dan Carter filed a complaint in Cabell Circuit Court against The Kroger Co. d/b/a Kroger and Saul N. Adkins alleging that they breached their duty to maintain their premises in a reasonably safe condition. The alleged incident occurred at the Kroger store in Huntington's West End.
According to the complaint, on July 21, 2018, Carter was shopping at the defendants' store when he allegedly slipped on an unknown substance, which caused him to fall and suffer personal injuries. Adkins, as manager, was responsible for inspecting, maintaining and insuring the general maintenance of the premises for its customers.
The plaintiff holds The Kroger Co. d/b/a Kroger and Saul N. Adkins responsible because they allegedly failed to provide reasonable and adequate maintenance to the premises and failed to warn the public generally of any hazards and/or dangerous and defective conditions.
The plaintiff requests a trial by jury and seeks judgment for compensatory damages, pre- and post-judgment interest, court costs, attorney's fees and any other relief that the Court deems just and appropriate. He is represented by Kenneth P. Hicks of Kenneth P. Hicks, LC in Huntington.
