Putnam sheriff sues pharmacy alleging failure to pay property taxes

WINFIELD — A sheriff's department is suing a pharmacy, citing alleged breach of contract.

The Putnam County Sheriff's Department-Tax Division filed a complaint in Putnam Circuit Court against Broadway Clinic Pharmacy, Inc. d/b/a Custom Script Pharmacy alleging that it refused to pay property taxes.

According to the complaint, the plaintiff alleges that it has suffered economic injury as a result of the malicious conduct of the defendant in refusing to provide payment for property taxes in the amount of $13,286.77 due and owing for the 2015 tax year. 

The plaintiff holds Broadway Clinic Pharmacy Inc. d/b/a Custom Script Pharmacy responsible because it allegedly failed to fulfill its property tax obligations and obligated the plaintiff to retain legal counsel to prosecute action.

The plaintiff requests a trial by jury and seeks judgment against the defendant for $13,286.77 plus interest and costs. It is represented by James B. Atkins, Paul S. Atkins and Bree Whipp Ogle of Atkins & Ogle Law Offices LC in Buffalo.
