NEW MARTINSVILLE — A Texas company is suing a West Virginia corporation, citing alleged breach of contract.
TH Exploration II, LLC filed a complaint in Wetzel Circuit Court against WV Minerals, Inc. alleging that it made false claims to 38 mineral tracts located in Wetzel County.
According to the complaint, in 2002, pursuant to two deeds executed and recorded, TH Exploration II acquired all of the rights, titles and interest of Spartan Exploration Company's 38 mineral tracts located in Wetzel County that were previously owned by the defendant. The plaintiff claims WV Minerals acquired no rights, titles or interest in the 38 disputed mineral tracts by virtue of 2011 Spartan Deeds.
The plaintiff holds WV Minerals, Inc. responsible because it allegedly persists in asserting its false claim of ownership in the 38 disputed mineral tracts despite having notice of TH Exploration II's true and proper ownership.
The plaintiff requests a trial by jury and seeks declaratory judgment, award of costs of action and such other relief as the Court may deem proper and appropriate. It is represented by Dennis A.
