Disabled worker accuses PetSmart of wrongful termination

CHARLESTON — A qualified disabled person is suing his former employer citing alleged disability discrimination and wrongful or constructive eviction.

Joshua Cassidy filed a complaint in Kanawha Circuit Court against PetSmart Inc. alleging that it  violated the West Virginia Human Rights Act.

According to the complaint, Cassidy alleges that on Oct. 23, 2018, he was constructively discharged from his employment. He was caused to suffer lost wages and fringe benefits, pain and suffering, mental anguish, humiliation and embarrassment. 

The plaintiff holds PetSmart Inc. responsible because it allegedly failed to provide reasonable accommodation and constructively terminated him for requesting leave to treat his bipolar disorder.

The plaintiff requests a trial by jury and seeks all damages, with interest, attorney's fees, costs and such other just and equitable relief. He is represented by R.R. Fredeking II of Fredeking & Biser Law Offices in Huntington.
