Former salesman sues Dutch Miller Kia alleging unpaid wages

HUNTINGTON — A salesperson is suing his former employers, citing alleged unpaid wages and earnings.

Derek Parsons filed a complaint in Cabell Circuit Court against Dutch Miller Kia, et al., alleging that they maliciously and vexatiously refused to pay his wages and earnings.

According to the complaint, Parsons alleges that he became employed by the defendants on or about May 2014 as a salesperson whose earnings were paid by commission. His first paycheck of approximately $6,500 was withheld and was to be paid upon his termination. Upon his termination, his last paycheck was $3,500. He never received either paycheck. As of the filing of this complaint, he is now owed approximately $10,000 in unpaid wages and earnings, and he cannot file state or federal income taxes for the years 2015-2016 because the defendants withheld his tax documents.

The plaintiff holds Dutch Miller Kia, et al. responsible because they allegedly refused to provide his federal W-2 tax statement and they failed to pay him his first and last paychecks.

The plaintiff requests a trial by jury and seeks all unpaid wages and earnings in the sum of $10,000, with punitive damages, costs, fees and expenses. He is representing himself.
