Estate executor sues nursing home alleging wrongful death

BECKLEY — An estate executor is suing nursing home facility operators citing alleged negligence and reckless misconduct.

Randy Basham, executor of the estate of Bonnie Basham, filed a complaint in Raleigh Circuit Court against Harper Mills and Stonerise Healthcare LLC alleging that they negligently violated Bonnie Basham's residents' rights.

According to the complaint, Randy Basham alleges that on Feb. 7, 2018, Bonnie Basham was first admitted to the defendants' nursing home facility for rehabilitation and assistance. As a result of the defendants' systemic abuse and neglect, she sustained serious injuries, including but not limited to acute kidney injury and recurrent sepsis secondary to urinary tract infection, all contributing to her death on April 15, 2018. 

The plaintiff holds Harper Mills and Stonerise Healthcare LLC responsible because they allegedly failed to provide an environment free of accident hazards, abuse, neglect and mistreatment, and failed to provide adequate and appropriate health care and protective services.

The plaintiff requests a trial by jury and seeks all damages, attorney's fees, costs and all other relief that the Court sees fit to award. He is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart | Bell PLLC in Charleston.
