Woman says she was fired after complaining about improper conduct at oral surgery clinic

WINFIELD — A woman is seeking damages, claiming that she was terminated after complaining about a harassment issue in the workplace.

Kelli M. Bails filed a complaint in Putnam Circuit Court against Drs. Krajekian, Brock and Henderson Inc., d/b/a Mountain State Oral & Facial Surgery and Drs. Jack Krajekian and John Brock as individuals.

According to the complaint, in July 2016, while Bails was working as the chief operating officer at the defendants' office — where, the suit states, she always completed her work with excellence—she became aware of improper conduct in the workplace. Namely, Brock was listening to a crude radio program that used derogatory terms for females while there were female staff members in the room. Bails also claims that Brock failed to complete medical procedures to the appropriate standard, such as letting unqualified employees administer general anesthetics. Bails issued a complaint concerning the workplace situation but was terminated as a result in August 2017, she alleges.

The defendants are accused of unfair termination, creating a hostile work environment, harassment and breach of the standard of care.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. She is represented by Rodney A. Smith of Bailess Smith PLC in Charleston.

The case has been assigned to Judge Phillip M. Stowers.
