Woman claims neighbor, Laroche Tree Service removed tree that was on her property

WHEELING – A woman is seeking damages following a tree removal that she did not permit.

Monica Hartman filed a complaint in Ohio Circuit Court against Terry Hubbard and Laroche Tree Service.

According to the complaint, on Feb. 2, 2017, the defendant employed Laroche to remove a tree. The suit states the defendant cut down and removed a tree on the other side of the fence line that split the plaintiff's property from the defendant's. The suit states the plaintiff did not given permission for the tree, which was on her property, to be cut down and removed.

The defendant is accused of negligence and failure to receive consent for action taken.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michael Baum of Edmond & Baum in Wheeling.

The case has been assigned to Judge David Sims.
