Man claims he was struck by driver who failed to stay in his lane

WHEELING – A man is seeking damages after he claims he was struck by a negligent driver.

Ronald J. Smith filed a complaint in Ohio Circuit Court against Benjamin Cool, Erie Insurance Property and Casualty Co., and Westfield Insurance Co., underinsured motorist carriers.

According to the complaint, on Feb. 3, 2017, the defendant was negligent in the operation of his motor vehicle. The defendant was driving the vehicle on Skin Creek Road in Lewis County when he allegedly struck the plaintiff's car after crossing over the middle, dividing line. The plaintiff claims to have sustained serious injuries due to the defendant's negligence.

The defendant is accused of negligence and failure to prevent an incident from taking place as well as reckless driving.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Dino Colombo in Morgantown.

The case has been assigned to Judge Jason Cuomo.
