CNX Gas Co. is accused of extracting resources from private property without permission

MOUNDSVILLE – A couple claims an energy company used their private property without permission for gas extraction.

Russel Allen Dotson Jr. and Jodi D. Dotson filed a complaint in Marshall Circuit Court against The Marshall County Coal Co. and CNX Gas Co. LLC.

According to the complaint, the defendants extracted gas from a 144-acre tract that belongs to the plaintiff. The suit states the defendants were wrong in their action and that the ownership of the property must be returned to the plaintiffs.

The defendants are accused of trespassing on and utilizing private property.

The plaintiff is seeking all reasonable sums due, attorney's fees and court costs. The plaintiff is represented by Jeremy McGraw in Wheeling.

The case has been assigned to Judge Jeffrey Cramer
